Gold Preferred Service Policy – Terms & Conditions
Coverage:
- This policy covers only electrically operated units inside the equipment. It does not cover electrical or plumbing work beyond the units, or work required due to negligence, misuse, fire, flood, acts of God, sabotage, freezing, or other circumstances beyond our control.
Multiple System Coverage
- For households with more than one HVAC system, the Gold Preferred Service Policy must be purchased for all systems in the home. This ensures consistent maintenance, full eligibility for benefits, and simplifies scheduling. Partial coverage of individual systems within the same household is not permitted.
Policy Acceptance:
- Nelson’s HVAC, LLC reserves the right to reject any policy if a technician inspection finds the equipment is in a condition that would make service unsatisfactory. Equipment must be brought up to industry standards at the customer’s expense before acceptance at the first maintenance check.
- Nelson’s HVAC, LLC shall not be responsible for system design or performance except through failure of covered equipment.
Service Hours & Emergency Service:
- Regular service is provided Monday–Saturday, 7:30 AM–10:00 PM.
- Maintenance checks are scheduled Monday–Friday during working hours.
- Emergency service is available 24/7, with no overtime charges.
Repair or Replacement:
- Nelson’s HVAC, LLC will determine whether to repair or replace defective parts.
- If equipment is not economically repairable, a replacement quote will be provided. No further service will be performed until replacement occurs.
Transfer & Relocation:
- Policies cannot be assigned or transferred without written consent.
- Policies do not transfer to a new address.
- If a customer relocates, Nelson’s HVAC, LLC may, at its sole discretion, decide whether to offer any credit or discount for the unused portion of the policy toward a new Gold Preferred Service Policy. Any credit or discount, if offered, applies only if the new location is within our service area, and the decision to offer it at all is entirely at Nelson’s HVAC, LLC’s discretion.
Third-Party Work:
- Any repairs, adjustments, or modifications performed by others without written authorization from Nelson’s HVAC, LLC will terminate our obligations under this agreement.
Additional Costs:
- Nelson’s HVAC, LLC is not required to supply items needed to meet local codes or regulations unless extra costs are paid by the customer.
- Unnecessary or nuisance calls (e.g., dirty filters, fuses, manual resets) will be charged at prevailing service rates.
Liability:
- Nelson’s HVAC, LLC will strive for prompt and efficient service, but is not liable for any damage or loss caused by delay or any other circumstance arising from this agreement.
Renewal:
- This agreement is not automatically renewable. Nelson’s HVAC, LLC will contact customers before policy expiration to provide renewal options.
Non-Refundable Clause:
- All Gold Preferred Service Policies are non-refundable. Once purchased, no portion of the policy fee can be refunded.
Termination of Policy:
Nelson’s HVAC, LLC reserves the right to suspend or terminate any Gold Preferred Service Policy, without refund, under the following circumstances:
- Failure to maintain accounts in good standing, including non-payment of invoices or outstanding balances.
- Repeated cancellation of scheduled service appointments or failure to provide reasonable access to equipment.
- Abuse, harassment, or unreasonable demands placed on Nelson’s HVAC, LLC staff or technicians.
- Any violation of the Terms & Conditions outlined in this agreement.
In the event of termination, all policy benefits and obligations will immediately cease.
Agreement & Updates
By purchasing the Gold Preferred Service Policy, the customer acknowledges and agrees to the terms and conditions outlined above. Nelson’s HVAC, LLC reserves the right to modify or update these terms at any time.
